He later stated that harsher penalties for child pornography would not be implemented until “a Justice like [Judge Schneider] has evidence brought into court in a case like that of Yong Jun Kim, and it’s going to be his kid being forced to perform fellatio on a man and sent around the world on the Internet.” Derringer “made improper personal assaults on the judge,” according to the Canadian Broadcast Standards Council (CBSC), and “[the] Derringer commentary … sanctioned or fostered possible personal attacks on the judge’s children.”

In response to the lawsuit and a complaint filed by Justice Schneider’s ex-wife with the CBSC, the radio station recognized Schneider’s concerns while defending Derringer’s actions as “without genuine malice.” CILQ-FM claimed in a letter to Schneider that “the Program, like many radio programs, may often be contentious in nature and not for everyone’s taste.” However, many of Q107’s core audience, which is primarily individuals aged 25 to 54, particularly men, find the program amusing [sic].” Furthermore, he offered an on-air apology, and the station was compelled to run a series of notifications detailing the disputed words following the CBSC’s verdict.

In an August 31, 2005 essay for the Toronto Sun, he was chastised for his support for the Ontario Hells Angels chapters.
